Guardianship and Conservatorship

At Hillsboro Law Group PC, we assist families navigating the complex and often emotional process of establishing guardianships and conservatorships. These legal tools are designed to protect individuals who are unable to make important decisions for themselves due to age, disability, or incapacity.

Guardianship is a court-appointed role that gives one person (the guardian) legal authority to make personal and medical decisions for another (the protected person), often a minor or an incapacitated adult. This may include decisions about living arrangements, education, and healthcare. In contrast, a conservatorship grants authority over the protected person's finances and property. The conservator is responsible for managing assets, paying bills, and keeping accurate financial records, all under the supervision of the probate court.

For minor children who receive inheritances or settlement funds, we also help families explore the use of UTMA accounts (Uniform Transfers to Minors Act). These custodial accounts allow an adult to manage funds on behalf of a minor without the need for a formal conservatorship. UTMA accounts can be a cost-effective and flexible way to hold assets until the child reaches the age of majority, typically age 21 in Oregon.
