Probate is the court-supervised process of validating a will (if one exists), appointing a personal representative, identifying and valuing estate assets, paying debts and taxes, and distributing property to heirs or beneficiaries. In Oregon, probate is generally required when someone passes away owning real estate worth more than $200,000 or more than $75,000 in personal property that was not held in trust or designated with a beneficiary. Smaller estates may be addressed by filing a Simple Estate Affidavit in lieu of a full probate.
